Arizona Center for Disability Law
J.K. v. Eden
- The Center recently
entered into a settlement to resolve a 10-year-old lawsuit filed on behalf of
AHCCCS eligible children who need mental health services. The defendants are the
Arizona Department of Health Services and Arizona Health Care Cost Containment
System. The State agreed to a fundamental shift in the way it treats children
and families. The agreement is founded on a set of principles that stress
treating children and families with respect and promoting collaboration among
agencies. The State must, as quickly as possible, conform all contracts,
decisions, practice guidelines and policies related to children's behavioral
health services to be consistent with principles outlined in the settlement and
make other specific changes to its service delivery system. Children and their
parents may read the agreement and comment on the fairness of the agreement in
writing.
