Arizona Center for Disability Law

On March 24, Center attorneys filed a brief in opposition of Glendale Union High School's Petition for Writ of Certiorari by the U.S. Supreme Court of a decision by the Ninth Circuit Court of Appeals that GUHSD - - and other Arizona school districts - - are not an arm of the state entitled to immunity from liability under the employment provisions of the Americans with Disabilities Act.  GUHSD asks the U.S. Supreme Court to review and reverse an earlier decision by the Ninth Circuit to deny GUHSD's Motion to Dismiss Ms. Savage's lawsuit against GUHSD for discriminating against her because of her disability.  In her lawsuit, Ms. Savage, a person who is quadriplegic, claims that she was unlawfully required as a condition of her employment as an education services technician to mount a flag and flagpole on her wheelchair.  When she refused because she believed the action was discriminatory and in violation of her rights as a person with a disability, she was fired.
